រដ្ឋដែល​ទាមទារ​ការការពារសិទ្ធិរបស់ពួកគាត់ លើសិទ្ធិដីធ្លី សិទ្ធិធនធានធម្មជាតិ និងសិទ្ធិ​ការងារ។​ យើងខ្ញុំទាំងអស់​ គ្នាមិនមែន​សំដៅតែលើព្រឹត្តិការណ៍បានកើតឡើងនៅថ្ងៃទី២២ ខែឧសភា ឆ្នាំ២០១២​ ដែលអ្នក​តវ៉ាដោយសន្តិវិធីរាប់​ សិបនាក់​ ជាប្រជាជននៅតំបន់បឹង កក់ត្រូវបានបង្ក្រាបដោយហិង្សា និងពីរថ្ងៃ​ក្រោយមក​ តំណាងប្រជាពលរដ្ឋបឹង​
កក់ចំនួន​១៥នាក់(ស្រី ១៤នាក់ និងប្រុស១នាក់)ត្រូវបានចាប់ខ្លួន​បញ្ជូនទៅតុលាការ​ និងកាត់ទោសដាក់ពន្ធនាគារ​
ព្រៃសរ​ ដោយគ្មានភស្តុតាងគ្រប់គ្រាន់ប៉ុណ្ណោះទេ ប៉ុន្តែឧប្បត្តិ​ហេតុបាញ់សម្លាប់ថ្មីៗ​ ដូចជាសម្លាប់លោក ឈុត វុទ្ធី​​ សកម្មជនបរិស្ថាននៅខេត្តកោះកុង ការបាញ់សម្លាប់​កុមារី ហេង ចាន់ថា អាយុ​ ១៤ឆ្នាំនៅខេត្តក្រចេះ និងការបាញ់​​ ប្រហារ លើស្រ្តី ៣រូប ដែលទាមទារលក្ខខណ្ឌ​ការងារល្អប្រសើរនៅខេត្ត​ស្វាយរៀង។ ឧប្បត្តិហេតុទាំងនេះគឺគួរឲ្យ​
ព្រួយ​បារម្ភយ៉ាងខ្លាំង ព្រោះវាបង្ហាញនូវការ​កើនឡើងនៃការត្រៀម​ជាមុននូវកងកម្លាំងសន្តិសុខ និងយោធាក្នុងការ​
​ប្រើកម្លាំង​ប្រឆាំងនឹងជនស៊ីវិលរហូតដល់​បាត់បង់ជីវិត។

ក្នុងឆ្នាំ២០១២ យ៉ាងហោចណាស់ មានករណីបែបនេះចំនួន ប្រាំ បានកើតឡើង ដោយមិនបានរាប់បញ្ចូលករណី​​
រំលោភសិទ្ធិមនុស្សផ្សេងៗទៀតឡើយ។ យើងខ្ញុំមានកង្វល់ រន្ធត់ និងក្រៀមក្រំយ៉ាងខ្លាំង អំពីកំណើននៃអំពើហិង្សា​​
នេះ ជាពិសេសវិវាទទាក់ទងនឹងសម្បទានដីសេដ្ឋកិច្ច។ មាត្រា៤១ នៃរដ្ឋធម្មនុញ្ញកម្ពុជា និងអនុសញ្ញាអន្តរជាតិនានា​​​
ដែលប្រទេសកម្ពុជា ជាភាគីហត្ថលេខីបញ្ជាក់ថា ប្រជាពលរដ្ឋមានសិទ្ធិជាមូលដ្ឋានក្នុងការ​សម្តែងមតិដោយសេរីដែល​​
​រួមមានសិទ្ធិតវ៉ាទាមទារនឹងសេចក្តីសម្រេចរបស់អាជ្ញាធរសាធារណៈ ដែលរំលោភលើសិទ្ធិ និងជីវភាពរបស់ពួកគេ។​​​ក្នុងការអនុវត្តន៍ ជាក់ស្តែង ការអនុវត្តន៍សិទ្ធិនេះ មិនត្រូវបានគោរព ឬទទួលរងការបង្ក្រាប​ដោយហិង្សា។

ប្រជាជនកម្ពុជាមានសិទ្ធិរស់នៅក្រោមនីតិរដ្ឋ។ ពួកគាត់ត្រូវទទួលបានកិច្ចការពារ និងសេវាកម្មប្រកបដោយសេច​
ក្តីថ្លៃថ្នូរ និងយុត្តិធម៌ ដោយផ្អែកលើសិទ្ធិជាមូលដ្ឋានដែលត្រូវបានទទួលស្គាល់ជាសកល។ អាជ្ញាធរសាធារណៈ​
មិនមែនមាន​តែ​កាតព្វកិច្ច និងករណីយកិច្ចក្នុងការធានាឲ្យបានថា វប្បធម៌និទណ្ឌ ភាពមិនត្រូវបានលើកលែង​
ប៉ុណ្ណោះទេ ប៉ុន្តែការប្រយុទ្ធប្រឆាំងនឹងនិទណ្ឌភាពត្រូវចាត់ទុកជាកិច្ចការអទិភាពមួយរបស់អាជ្ញាធរសាធារណៈ។​ គ្រប់ករណីទាំងអស់ដែលទាក់ទងនឹងការប្រើអាវុធប្រឆាំងជន ស៊ីវិល គប្បីត្រូវស៊ើបអង្កេតជាបន្ទាន់ដោយលម្អិត​ និងដោយឥតលំអៀង។ ការស៊ើបអង្កេតដែលបានរកឃើញថា ការបាញ់ប្រហារទាំងឡាយគឺ“ដោយចៃដន្យ”​ ឬថាដោយសារមន្ត្រីថ្នាក់ទាបបានធ្វើសកម្ម ភាពតាមទំនើងចិត្តរបស់ខ្លួន គប្បីត្រូវបានគាំទ្រដោយភស្តុតាងដែល​
បានប្រមូលក្នុងលក្ខណៈម៉ឹងម៉ាត់ និងតម្លាភាព។ ដោយឡែកសាក្សីគួរគប្បីត្រូវបានការពារពីការ​គម្រាមកំហែង​​​និងការបំភិតបំភ័យ ហើយ ជនរងគ្រោះទាំងអស់ គប្បីទទួលបានការដោះស្រាយតាមផ្លូវតុលាការប្រកបដោយ​​
​ប្រសិទ្ធភាព និងយុត្តិធម៌។

ទោះបីជាសម្តេចនាយករដ្ឋមន្ត្រី ហ៊ុន សែន បានប្រកាសមិនឲ្យប្រើប្រាស់អាវុធប្រឆាំងនឹងអ្នកតវ៉ានិងបាន​ចេញ​បទ​
បញ្ជាប្រកាសឱសានវាទលើការផ្តល់សម្បទានដីសេដ្ឋកិច្ចថ្មីៗនេះ ករណីបាញ់ប្រហារនៅតែមាន​កើតឡើង។អង្គការ​
សង្គមស៊ីវិល សូមស្វាគមន៍ចំពោះបទបញ្ជារបស់សម្តេចនាយករដ្ឋមន្ត្រី ដែលសំដៅលើក​ស្ទួយស្ថានភាពសិទ្ធិមនុស្ស​
នៅកម្ពុជា។ ជាពិសេសបទបញ្ជានេះគប្បីត្រូវមានគោល ការណ៍ណែនាំលម្អិតនិង​កំណត់អំពីរបៀបដែលអាជ្ញាធរ​
សារធារណៈ រួមមានអាជ្ញាធរថ្នាក់មូលដ្ឋាន និងថ្នាក់ខេត្ត និងកងកម្លាំងប្រដាប់​​អាវុធ​ទាំងអស់ ត្រូវអនុវត្តឲ្យបាន​
ម៉ឹងម៉ាត់និងជាប្រព័ន្ធ។

ការពិនិត្យមើលឡើងវិញលើក្រុមហ៊ុនទទួលបានសម្បទានដែលកំពុងវិនិយោគនៅកម្ពុជា គឺមានសារៈសំខាន់​​ណាស់​
ដើម្បីធានាថា ក្រុមហ៊ុនទាំងនោះ គោរពទៅតាមក្របខណ្ឌគតិយុត្តិជាតិ និងអន្តរជាតិ។ ការខ្វះខាត​​ធនធាន ឬ​
សមត្ថភាពបច្ចេកទេសនានា គប្បីត្រូវកំណត់និងដោះស្រាយ ហើយការអនុវត្តន៍ សេចក្តីសម្រេច​​ទាំងនេះគប្បីត្រូវ​
​បានតាមដាននិងរាយការណ៍ជូនសាធារណៈជន។

យើងខ្ញុំជាអង្គការសង្គមស៊ីវិលចំនួន១២១ ដែលបានចុះហត្ថលេខាគាំទ្រសេចក្តីថ្លែងការណ៍នេះជឿជាក់ថា​ អំពើហិង្សា​
ប្រឆាំងនឹងជនស៊ីវិល ជាទង្វើមិនអាចទទួលយកបានគ្រប់កាលៈទេសៈ និងគប្បីបញ្ឈប់ជាបន្ទាន់​ ហើយយើងខ្ញុំនឹង​
តាមដានករណីនីមួយៗទាក់ទងនឹងសិទ្ធិដីធ្លី សិទ្ធិធនធានធម្មជាតិនិងសិទ្ធិការងារបន្តទៀត។ ម្យ៉ាងទៀតយើងខ្ញុំនឹង​
បន្តស្វែងរកកិច្ចសហការ​ ជាមួយរាជរដ្ឋាភិបាលកម្ពុជា ក្នុងគោលដៅពង្រឹងនីតិរដ្ឋ និង​​លប់​បំបាត់វដ្តនៃអំពើហិង្សា​
